TERMS OF SERVICE
By commissioning me, you are agreeing to the following terms. Please read carefully before placing an order.
GENERAL
- Commissions are for personal use only unless commercial rights are purchased (additional fees apply depending on service).
- My artwork may be used for personal display such as profile pictures, banners, posting on socials with credit, or printing for yourself, but may not be used for profit without prior agreement.
- AI/NFT use is strictly prohibited. My work may not be used in AI datasets, engines, or minted as NFTs.
- I reserve the right to decline commissions outside my abilities or for subjects I will not draw.
- You receive 3 free revisions (sketch stage only).
- Progress updates are available upon request, including: sketch, lineart, base color, final artwork (with and without watermark), and speedpaint.
- The final artwork will be delivered via email or Google Drive and will be provided in both watermarked and non-watermarked formats. Please download and back up your files within 30 days, as the Google Drive link may be removed after this period. I am not responsible for lost files after this timeframe.
PAYMENT & FEES
- A 25% deposit of the total fee is required before I begin the sketch for all payment methods except VGen and Kirke.
- For commissions made through VGen or Kirke, full upfront payment is required according to the platform’s system.
- Once the sketch (including revisions) is completed, the remaining 75% must be paid.
- Payments to proposals should be paid fully within 1 month or will be declined.
- All payments must be paid through the agreed platform.
- A Non-Disclosure Agreement (NDA) fee of $100 applies if you request that I do not post your commission publicly or use it as part of my Portfolio.
- If a Commissioner wishes to buy Commercial Use AFTER a commission, the prices will be: + 100% of base price for Monetized Content Use / Merchandise Commercial Use.
- PSD source file is available upon request with an additional fee of +10% of the base price.
REVISIONS
- You receive 3 free revisions (sketch stage only). Additional revisions cost $2 each, paid before I continue.
- Revisions are only available during the sketch phase.
- Communication is important. If I do not receive a response within 1 week, I will proceed and deliver the artwork as is. Please provide all feedback at the sketch stage.
- Once sketches are approved, no further changes will be made unless due to an error on my part. Mistakes I make will always be corrected at no cost.
Communication
- Communication is handled through the platform used for the commission or another agreed platform.
- Progress updates are available upon request at any stage of the commission.
- Clients are encouraged to provide all feedback during the sketch phase.
- Changes after approval may not be accepted.
- If I do not receive a response within 7 days, I will continue the commission based on the latest confirmed direction.
DEADLINES AND DELIVERY
- Commissions are typically completed within 1 month, but may take up to 3 months depending on complexity, queue, health, or personal matters.
- I will keep you updated if delays occur.
- If you wish to skip the queue and receive priority processing, a Rush Fee of 60% of the base price will be applied. Please contact me via direct message or indicate it in the request form if you would like to add this option.
INTELLECTUAL PROPERTY RIGHTS
- I, the artist, retain all rights to the commissioned artwork.
- You are purchasing usage rights, not ownership of the artwork itself.
- I may use the artwork to: promote myself and my services, post on social media and in my portfolio, create prints/merchandise (for fanart commissions only).
- Exceptions: If an NDA was purchased, the artwork will not be posted or used for promotional purposes.
- PSD file is not included unless discussed and purchased separately.
REFUNDS
- I may cancel and refund a commission at any time.
- You may cancel before payment is made.
- Refunds are not available unless I am unable to complete the commission.
- Chargebacks are strictly prohibited.
- Filing a chargeback will: forfeit your rights to use the artwork, place you on a public blacklist (with evidence), allow me to resell or reuse the artwork as I see fit, result in a formal complaint against you.
COMMISSIONER RIGHTS
You may:
- Use the artwork for personal purposes only (unless commercial rights are purchased).
- Print the art for yourself.
- Post it on Social Media with credit to me "@rubluene".You may NOT:
- Use the artwork commercially without permission.
- Claim the artwork as your own or fail to credit me.
- Remove the signature or watermark when posting the artwork on social media.
- Resell or redistribute the artwork.
- Modify the artwork without my consent.
- Use artwork purchased for Personal Use in merch, streaming, or commercial projects.
BLACKLIST POLICY
- Breaking these rules may result in a permanent public blacklist (with evidence).
- The blacklist may be shared with other artists.
